Rules & Regulations

The following were adopted at the 2004 Annual Homeowner’s meeting.

Boats & Trailers –
• Bay Street owners use East side of Bay Street for storage of a boat on a trailer if necessary, otherwise park under the house. Owner responsible to cut grass and control weeds. Trailers, while not required to have license, must be mechanically serviceable.

• Boyt Road owners may keep a trailer, for a boat currently in their boathouse, on the lawn provided it is maintained mechanically serviceable and the grass and weeds are controlled properly.

• Exception! A Kayak and/or Jon Boat is allowed on the owners dock or yard. The vessel must be serviceable and the owner is responsible for proper care and control of grass and weeds.

Canal
• No Wake.
• Place nothing in the canal but the spoils from cleaning freshly caught fish into the canal.
• No Litter.
• No skinny dipping.
• No parking at the boat ramp.
• Please replace chain after using ramp.
• Boats must not block the canal. Boats of visitors may be tied to the owner’s boathouse, but must not extend into the canal by more than one boat width. EXAMPLE: Two visiting boats may be tied one in front of another, both parallel to the boathouse, but not side by side. RECOMMENDATION: Face bow of boats to ICW.

Civility
• Each and every owner has a right to “Quiet Enjoyment” of his/her property. A “Peace & Quiet” zone should be respected between 12 P.M. and 6 A.M.
• Anyone having a complaint against one’s neighbor must first directly approach the neighbor and be unable to resolve the issue before approaching the Board.
• Social events hosted by a homeowner that employs the use of a band or the playing of audio music shall not do so after 12 P.M.
• If another homeowner objects to the music, they should do so in person of by phone directly to the offending homeowner. Calling the Sheriff should be a last resort, not the first.

General
• No open fires.
• No smudge pots.
• No fireworks!
• No signs other than “For Sale” and “No Wake”.


Houses
• Houses are to be maintained in good repair.
• Rehabilitation and reconstruction must be completed in a reasonable period of time. Reasonable time should be 9 months.
• In no case shall tar paper, insulation, particle board or any other ordinarily concealed construction material be exposed in excess of 4 months.

Mobile Homes / RV’s
• Mobile Homes are NOT allowed at all.
• RV’s are allowed, but not to exceed 2 weeks.
• Camper trailers and “Pop Ups” are allowed, but not to exceed 2 weeks.

Pets
• Observe Galveston County Law
• Dogs must be on leashes.
• Maximum (3) cats or dogs TOTAL.
• No pets other than: cats, dogs, [birds & fish (kept indoors)]
• Any exceptions require Board approval.

Trash
• Each owner is responsible for providing for trash removal with a private contractor at their own expense.
• Owners should make every attempt NOT to leave put trash out before the days of normal trash pickup.
• If a non-permanent resident must leave trash out overnight, they must designate some willing permanent resident to care for their cans and/or any trash cleanup that may be required.

Yards
• Each owner is required to provide for lawn care at their own expense.
• Owners of lots not properly maintained will be notified in writing by the Board advising the owner of the condition. Owner’s failure to properly respond will have their lawn maintained at the Boards direction and at the owner’s expense.

Value
• The Board of Directors believes strongly in the maintaining and increasing every owner’s property value. To that end, the Board may from time to time communicate with individual owners regarding the opportunities they have to increase their individual value.
• Where not required, owners receiving such communication are urged to consider the Boards recommendations as they are for the good of ALL owners.

Vehicles
• Yards are not storage lots. No storage of trucks or autos that are inoperable due to:
Mechanical problems, or expired inspection sticker or expired license sticker.
